The following terms and conditions (“Terms”) apply to and govern your access to and use of this web-based platform (the “Platform”) which are operated by or for or on behalf of YDCare. Please read these Terms carefully before using this Platform. By accessing to this Platform, you accept and agree to be bound by these Terms.
These Terms may be revised at any time by YDCare without any notice to you. The revised Terms will take effect immediately when they are posted on the Platform. You agree to review the Terms regularly to be aware of such modifications. Your continued access to or use of the Platform after such modifications shall be deemed to constitute your conclusive acceptance of the modified Terms.
You may register an account and create a profile (“User Profile”) on the Platform if you wish to use certain of the services available through the Platform (for example, to be included on our care elites’ database). In the registration process, you will need to create a username and password to set up your User Profile.
By registering with YDCare and creating a User Profile, you agree, confirm and accept that:-
YDCare may treat any access to or use of a Platform and/or the services available through a Platform through your User Profile as access or use by you, notwithstanding that it may have been accessed or used by any other person without your knowledge or authority.
If third parties gain access to Platform and/or the services available through a Platform through your User Profile, you shall be personally responsible and liable for any such access and use and you shall indemnify and hold harmless YDCare against all actions, claims, demands, liabilities, losses, damages, liabilities, costs, charges or expenses of whatever kind (including reasonable legal fees) by or against such third parties based upon or relating to such access and use.
You undertake to immediately notify YDCare if you know or suspect that your User Profile has been used in an unauthorized manner to access or use any of the Platforms and/or the services available through any of the Platforms. In such circumstances, you should immediately change the password to your User Profile and provide YDCare with such information relating to the unauthorized use as YDCare may request.
Your access to or use of the Platforms will be subject to any other guidelines, policies and regulations which may from time to time be implemented, varied and/or amended by YDCare, including the Privacy Policy (which can be found at the official website). By accessing to this Platform, you acknowledge that you have read and accepted the then-current version of Privacy Policy.
Any information that you disclose in the public areas of any of the Platform becomes public information. You should exercise caution when disclosing your personal information in this way.
You agree to maintain a respectful environment for everyone and use the Platform in a manner consistent with all applicable laws and regulations. Specifically, you agree to follow these basic rules of conduct:-
You shall be responsible for any content that you post or transmit on or through any of the Platform. Any comments, reviews or ratings made by you must be based on demonstrable facts, must be written fairly and objectively.
You agree that YDCare may, at its sole discretion or as required by law and policies, and without prior notice to you, take any action deemed appropriate by YDCare, including but not limited to suspending or terminating your User Profile or access to the Platform, ceasing to provide any services to you, and taking measures to restrict the your access to the Platform at any time, including but not limited to due to your breach of any Terms herein, technical connectivity issues, or events that beyond YDCare’s reasonable control.
YDCare shall be entitled at any time to add, change or withdraw any of the contents or functions available or to be made available on the Platform at its own discretion.
You acknowledge that YDCare shall have the right (but not the obligation) in its sole discretion to monitor, refuse or remove any content that is available on the Platform. Without limiting the foregoing, YDCare shall have the right to remove any content that violates these Terms or is otherwise objectionable.
You expressly agree that your access and/or use of the Platform is at your sole risk.
YDCare expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the following:-

Under no circumstances shall YDCare, its associated companies, affiliates or service providers, and/or any of their respective officers, directors, agents, joint ventures, employees or representatives or anyone involved in creating, producing or managing the Platform be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the Platform.
This Platform may contain hyperlinks or other redirection tools to third party websites that are owned and/or operated by persons other than YDCare (“Third Party Websites”). Your access to any external website or web page is at your own risk. YDCare is not responsible for the contents of or any of the information on or link to any Third Party Websites.
By the inclusion of any hyperlink or other redirection tools, YDCare shall not be deemed to endorse, recommend, approve, guarantee or introduce any third parties or the services/products they provide on their websites, or to have any form of cooperation with such third parties and websites unless otherwise stated by YDCare.
You are solely responsible for making all enquires and investigation before proceeding with any online or offline access to or dealing with any person through the Third Party Websites.
YDCare is not liable for any loss or damage incurred or suffered by you or any third party arising out of, in connection with or as a result of any access to or interaction with any other websites via this Platform.
Content available on the Platform (including information, communications, software, images, sounds contained on or available through the Platform) is provided by Homelistc, its content providers and third-party licensors. The intellectual property rights to or over the contents available on the Platform belong to Homelistc, its content providers and/or third-party licensors.
You may not reproduce, modify, transfer, distribute, republish, download, post, or transmit in any form or by any means, including electronic, mechanical photocopying or recording, any of the content available on the Platform without the prior written permission of Homelistc. All rights are reserved.
You agree to indemnify and hold harmless YDCare, its associated companies, affiliates and service providers, and their respective officers, directors, agents, joint ventures, employees or representatives from and against all claims, demands, actions, liabilities, loss, damages, costs and expenses of whatever nature (including legal costs on a full indemnity basis) arising from or in connection with your access to or use of the Platform, including but not limited to any violation of any laws, regulations or other legal rights, or any breach of the Terms herein.
These Terms shall be governed by, and construed in accordance with the laws of Hong Kong and you agree to submit to the non-exclusive jurisdiction of the courts of Hong Kong.

您承諾，若您知悉或懷疑您的用戶個人檔案被未經授權地使用以存取或使用任何平台及／或透過任何平台提供的服務，將立即通知 YDCare 。 在此情況下，您應立即更改您用戶個人檔案的密碼，並向 YDCare 提供其可能要求的與未經授權使用相關的資訊 。
您對平台的存取或使用將受 YDCare 可能不時實施、更改及／或修訂的任何其他指引、政策和規例所規限，包括《私隱政策》（可在官方網站上查閱）。 透過存取本平台，您確認已閱讀並接受當時最新版本的《私隱政策》。 您在任何平台公共區域披露的任何資訊都將成為公開資訊 。 您以此方式披露個人資訊時應謹慎行事 。

您明確同意，您存取及／或使用本平台的風險由您自行承擔 。 YDCare 明確否認任何形式的明示或默示保證，包括但不限於以下各項：-

本條款受香港法律管轄並按其解釋，您同意接受香港法院的非專屬司法管轄權 。
